Terms of Service

1. Acceptance of Terms

By accessing or using ServiceHub's mobile applications (AutoCustomer, AutoAdmin, AutoTowTruck) and websites (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and ServiceHub ("we," "our," or "us").

2. Description of Services

ServiceHub provides an automotive service management platform that:

  • Enables customers to track vehicle maintenance, mileage, and service history
  • Connects customers with automotive workshops and service providers
  • Allows workshops to manage appointments, customers, and services
  • Provides tow truck request and dispatch services
  • Facilitates communication between customers, workshops, and service providers

3. User Accounts

3.1 Account Registration

  • You must create an account to use most features of our Services
  • You must provide accurate, current, and complete information
  • You must be at least 18 years old to create an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

3.2 Account Types

  • Customer Accounts: For vehicle owners to manage their vehicles and book services
  • Workshop Accounts: For automotive service providers (requires subscription)
  • Tow Truck Accounts: For tow truck operators and companies

3.3 Account Security

You must immediately notify us of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. User Conduct

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Post false, misleading, or fraudulent information
  • Harass, abuse, or harm other users
  • Spam, send unsolicited messages, or engage in commercial solicitation
  • Upload viruses, malware, or any harmful code
  • Attempt to gain unauthorized access to our systems
  • Use automated tools (bots, scrapers) without permission
  • Impersonate another person or entity
  • Interfere with the proper functioning of the Services

5. Workshop Subscriptions

5.1 Subscription Plans

Workshop accounts require a paid subscription. Features and pricing vary by plan (Basic, Professional, Enterprise).

5.2 Payment Terms

  • Subscriptions are billed monthly or annually in advance
  • Payment is processed through third-party payment providers
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice

5.3 Subscription Limits

Each plan has limits on appointments, customers, and features. Exceeding limits may require an upgrade. If your subscription expires or is cancelled, access to premium features will be restricted.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you upload (photos, vehicle information, etc.). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely to provide the Services.

6.2 Our Intellectual Property

The Services, including all software, designs, text, graphics, and logos, are owned by ServiceHub and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer our Services.

7. Service Relationships

7.1 Platform Role

ServiceHub acts as a platform connecting customers with workshops and service providers. We are not responsible for the quality, safety, or legality of services provided by workshops or tow truck operators.

7.2 No Employment Relationship

Workshops and service providers are independent contractors, not employees or agents of ServiceHub.

7.3 Disputes

Disputes regarding services, pricing, or quality should be resolved directly between customers and service providers. We may assist in resolving disputes but are not obligated to do so.

8. Disclaimers and Limitations of Liability

8.1 No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICEHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

8.3 Service Availability

We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the Services at any time without notice.

9. Indemnification

You agree to indemnify and hold harmless ServiceHub, its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Services provided by you (if you are a workshop or service provider)

10. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees
  • Any other reason at our sole discretion

Upon termination, your right to use the Services immediately ceases. You may also delete your account at any time through the app settings.

11. Privacy

Our Privacy Policy explains how we collect, use, and protect your information. By using the Services, you agree to our Privacy Policy.

12. Modifications to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or in-app notification. Continued use of the Services after changes constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
